Terms and Fulfillment Disclosure

Effective Date: January 1, 2024

Thank you for choosing Valeria R. Creative (referred to as "we," "us," or "our") for your creative services needs. By engaging with our services, you agree to the following terms and fulfillment disclosure:

  1. Services:

    • We offer a variety of creative services including but not limited to creative consultations + strategy, graphic design, web design, brand identity design, and content creation.

    • Our services are provided on a project basis, and the scope of work, timelines, and deliverables will be outlined in a mutually agreed-upon contract once the proposal is approved AND a deposit/full payment is provided to secure your project on the Valeria R. Creative Calendar.

  2. Payment:

    • Payment terms will be outlined in the contract or agreement for each project.

    • A deposit or upfront payment may be required before the commencement of work, with the remaining balance due upon completion or as specified in the agreement.

    • All major credit cards are accepted via our chosen payment-secured portal Stripe.com.

  3. Communication:

    • We strive to maintain open and clear communication throughout the project via email and our chosen project management tool Asana.

    • You agree to promptly provide any necessary information, feedback, or approvals required for the timely completion of the project.

  4. Intellectual Property:

    • Unless otherwise specified in the contract or agreement, all intellectual property rights to the deliverables produced as part of the project will belong to you upon full payment.

    • We retain the right to showcase the completed work in our portfolio or promotional materials unless otherwise agreed upon in writing.

  5. Revisions:

    • We understand the importance of client satisfaction and strive to deliver high-quality work.

    • The number of revisions included in the project scope will be specified in the contract or agreement. Additional revisions may be subject to additional fees.

  6. Delivery:

    • We will make reasonable efforts to deliver the completed project within the agreed-upon timeline.

    • Delays may occur due to factors beyond our control, such as unforeseen circumstances or client-requested changes.

  7. Termination:

    • Either party may terminate the project by providing written notice if the other party breaches the terms of the contract or agreement.

    • In the event of termination, you agree to compensate us for any work completed up to the termination date.

  8. Refund Policy:

    • Refunds will be issued by the terms outlined in the contract with the client and are subject to the type of service invested upon.

    • In the event the Designer cannot or will not perform contracted obligations in any or all parts of your contract, it (or a responsible party) will:

      1. Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and

      2. Issue a refund or credit based on a reasonably accurate percentage of Services rendered.

  9. Return Policy:

    • Physical Products: Due to the nature of our process - prior to printing any assets you MUST review and approve the design. If you are not satisfied with your purchase of physical products (e.g., printed materials), no refunds are provided.

    • Digital products: Due to the nature of digital products (e.g., downloadable files), we generally do not accept returns. However, exceptions may be made on a case-by-case basis to update your assets at the designer’s hourly rate.

  10. Cancellation Policy:

    • Project Cancellation: If you wish to cancel a project or service, please notify us as soon as possible. Depending on the stage of the project and any work completed, cancellation fees may apply.

    • Subscription Services: For recurring subscription services, you may cancel your subscription at any time. However, please note that cancellation may not result in a prorated refund for the current billing period.

  11. Exceptions:

    • Customized or personalized products/services: Products or services that are customized or personalized according to your specifications may not be eligible for refunds or returns, except in cases of defects or errors on our part.

    • Services already rendered: Refunds may not be available for services that have already been completed or delivered unless otherwise specified in the agreement.

  12. Limitation of Liability:

    • Our liability for any damages arising from our services is limited to the fees paid for those services.

    • We are not liable for any indirect, incidental, or consequential damages, including loss of profits or business interruption.

  13. Changes to Terms:

    • We reserve the right to update or revise these terms and fulfillment disclosure at any time. Any changes will be effective immediately upon posting the updated terms on our website or providing notice to you.
